국내재산 도피 방지법

제1조(국내재산 도피 금지) 누구든지 국내에 있는 재산을 도피시킬 목적으로 외국 또는 군사분계선 이북의 지역으로 재산을 이동하거나 이동하는 결과를 생기게 하는 행위를 할 수 없다.

제2조(벌칙) 제1조를 위반하는 자는 10년 이하의 징역이나 금고 또는 100만원(圓) 이하의 벌금에 처한다. 다만, 해당 범죄행위의 목적물의 가격의 3배가 100만원(圓)을 초과할 때에는 벌금액은 해당 가격의 3배 이하로 한다.

제3조(적용 배제) 다음 각 호의 어느 하나에 해당하는 경우에는 제1조를 적용하지 아니한다.

1. 정부가 허가한 경우

2. 정부의 필요에 따라 재산을 이동하거나 이동하는 결과를 생기게 하는 행위를 하는 경우

3. 여행 또는 일시 체재(滯在)에 필요한 일상수요품을 이동하는 경우

제4조(양벌규정) 법인의 대표자, 대리인, 사용인, 그 밖의 종업원이 그 법인의 업무에 관하여 제1조의 위반행위를 하면 그 행위자를 벌하는 외에 그 법인에도 제2조의 벌금형을 과(科)한다. 다만, 법인이 그 위반행위를 방지하기 위하여 해당 업무에 관하여 상당한 주의와 감독을 게을리하지 아니한 경우에는 그러하지 아니하다.

제5조 삭제 <2010.3.31>

부칙 <제129호,1950.4.21> 제6조 본법은 공포일로부터 시행한다.

부칙 <제1143호,1962.9.17> 본법은 공포한 날로부터 시행한다.

부칙(정부부처명칭등의변경에따른건축법등의정비에관한법률) <제5454호,1997.12.13> 이 법은 1998년 1월 1일부터 시행한다. <단서 생략>

부칙 <제10213호,2010.3.31> 이 법은 공포한 날부터 시행한다.
