원격영상재판에 관한 특례법

제1조(목적) 이 법은 원격영상재판(遠隔映像裁判)의 실시에 필요한 사항과 원격영상재판에 관한 절차상의 특례를 규정함을 목적으로 한다.

제2조(정의) 이 법에서 사용하는 용어의 뜻은 다음과 같다.

1. "재판관계인"이란 법관, 당사자, 증인 등 법원의 재판절차에 참여하는 자를 말한다.

2. "원격영상재판"이란 재판관계인이 교통의 불편 등으로 법정(法廷)에 직접 출석하기 어려운 경우에 동영상과 음성을 동시에 송수신(送受信)하는 장치가 갖추어진 다른 원격지(遠隔地)의 법정에 출석하여 진행하는 재판을 말한다.

제3조(적용 범위) 법원은 다음 각 호의 사건에 대하여만 원격영상재판을 할 수 있다.

1. 「법원조직법」 제34조제1항 각 호의 사건(같은 항 제3호의 사건은 즉결심판하는 경우만 해당한다)

2. 원격영상재판을 하는 과정에서 발생하는 「법원조직법」 제61조제1항의 사건

3. 다른 법률에 따라 시법원(市法院) 또는 군법원(郡法院)의 권한에 속하는 사건

제4조(원격영상재판의 효과) 원격영상재판은 재판관계인이 동일한 법정에 출석하여 진행하는 재판으로 본다.

제5조(원격영상재판의 장치) 원격영상재판을 진행하기 위한 장치는 다음 각 호의 요건을 모두 갖추어야 한다.

1. 동영상 및 음성의 송수신 장치는 양쪽에 모두 갖추어져 서로 상대방을 보면서 대화할 수 있을 것

2. 동영상 및 음성의 전송은 양쪽에서 동시에 이루어질 것

3. 전송되는 동영상 및 음성은 권한이 없는 자가 송수신할 수 없도록 보안장치를 갖출 것

4. 그 밖에 대법원규칙으로 정하는 요건을 갖출 것

제6조(변호권 등의 보장) 법원은 소송대리인 또는 변호인이 당사자 또는 피고인과 서로 다른 법정에 출석하여 원격영상재판이 진행되는 경우에는 소송대리인 또는 변호인이 당사자 또는 피고인과 비공개로 대화할 수 있는 장치를 마련하여야 한다.

제7조(녹화) 원격영상재판을 할 때에는 재판의 진행상황 전부를 녹화하여야 한다.

제8조(시행규칙) 이 법 시행에 필요한 사항은 대법원규칙으로 정한다.

부칙 <제5004호,1995.12.6> 이 법은 공포한 날부터 시행한다.

부칙 <제10177호,2010.3.24> 이 법은 공포한 날부터 시행한다.
