제1조(목적) 이 법은 화재, 사변 또는 그 밖의 재난으로 소송기록이 멸실된 경우 법원이 민사ㆍ형사소송사건을 신속하게 처리할 수 있는 임시조치를 정하는 것을 목적으로 한다.

제2조(조치의 절차) 제1조의 재난이 발생한 때에는 소송관계인과 검사는 6개월 이내에 해당 법원에 대하여 다음 각 호의 구분에 따른 절차를 밟아야 한다.

1. 원고, 신청인 또는 상소인: 소장(訴狀), 신청서 또는 상소장의 부본(副本) 및 사건 계속(繫屬)을 소명할 자료의 제출

2. 검사: 공소사실(公訴事實)과 그 유지에 대한 자료의 제출

제3조(취하 및 취소 간주) 제2조의 소송관계인 또는 검사가 같은 조에 따른 기간에 정하여진 절차를 밟지 아니하는 경우에는 소ㆍ신청ㆍ상소는 취하된 것으로 보고, 공소는 취소된 것으로 본다.

제4조(공고) 제1조의 재난이 발생한 때에는 해당 법원장은 제2조의 소송관계인이 제출할 구체적인 소명 자료와 제출 날짜를 그 법원 관할의 지방법원 소재지에서 발간하는 일간신문에 2회 이상 공고하여야 한다.

부칙 <제113호,1950.3.22> 제5조 본법은 공포일로부터 시행한다. 제6조 본법은 본법 시행전에 법원재난의 경우에도 적용한다. 단, 제2조의 기간은 본법 시행일부터 4월로 한다.

부칙 <제10180호,2010.3.24> 이 법은 공포한 날부터 시행한다.
