제1조 (국내에서의 재산 이전) 「민법」 제1058조제1항에 따라 국가에 귀속(歸屬)하는 상속재산의 관리인은 피상속인(被相續人)의 주소지를 관할하는 세무서장에게 지체 없이 그 상속재산의 관리를 이전하여야 한다.

제2조 (국외에서의 재산 이전) 제1조의 경우에 피상속인의 주소가 외국에 있을 때에는 그 주소지를 관할하는 영사(領事) 또는 영사의 직무를 수행하는 사람에게 지체 없이 그 상속재산의 관리를 이전하여야 한다.

부칙 <제860호,1961.12.23> ①본법은 공포한 날로부터 시행한다. ②단기 4232년 칙령 제409호 상속인이광결하였을때국고에귀속하는재산의인도에관한건은 이를 폐지한다.

부칙 <제9806호,2009.10.21> 이 법은 공포한 날부터 시행한다.
