실화책임에 관한 법률

제1조(목적) 이 법은 실화(失火)의 특수성을 고려하여 실화자에게 중대한 과실이 없는 경우 그 손해배상액의 경감(輕減)에 관한 「민법」 제765조의 특례를 정함을 목적으로 한다.

제2조(적용범위) 이 법은 실화로 인하여 화재가 발생한 경우 연소(延燒)로 인한 부분에 대한 손해배상청구에 한하여 적용한다.

제3조(손해배상액의 경감)

① 실화가 중대한 과실로 인한 것이 아닌 경우 그로 인한 손해의 배상의무자(이하 "배상의무자"라 한다)는 법원에 손해배상액의 경감을 청구할 수 있다.

② 법원은 제1항의 청구가 있을 경우에는 다음 각 호의 사정을 고려하여 그 손해배상액을 경감할 수 있다.

1. 화재의 원인과 규모

2. 피해의 대상과 정도

3. 연소(延燒) 및 피해 확대의 원인

4. 피해 확대를 방지하기 위한 실화자의 노력

5. 배상의무자 및 피해자의 경제상태

6. 그 밖에 손해배상액을 결정할 때 고려할 사정

부칙 <제9648호,2009.5.8> ①(시행일) 이 법은 공포한 날부터 시행한다. ②(적용례) 이 법은 2007년 8월 31일 이후 이 법 시행 전에 발생한 실화에 대하여도 적용한다.
