관공서의 공휴일에 관한 규정

제1조(목적) 이 영은 「국가공무원법」 및 「공휴일에 관한 법률」에 따라 관공서의 공휴일에 관한 사항을 규정함을 목적으로 한다. <개정 2021.8.4>

제2조(공휴일) 관공서의 공휴일은 다음 각 호와 같다. 다만, 재외공관의 공휴일은 「국경일에 관한 법률」에 따른 국경일과 주재국의 공휴일로 한다. <개정 1998.12.18, 2005.6.30, 2006.9.6, 2012.12.28, 2017.10.17, 2026.4.30>

3. 1월 1일

4. 설날 전날, 설날, 설날 다음 날(음력 12월 말일, 1월 1일, 2일)

5. 부처님 오신 날(음력 4월 8일)

6. 노동절(5월 1일)

7. 어린이날(5월 5일)

8. 현충일(6월 6일)

9. 추석 전날, 추석, 추석 다음 날(음력 8월 14일, 15일, 16일)

10. 기독탄신일(12월 25일)

10의2. 「공직선거법」 제34조에 따른 임기만료에 의한 선거의 선거일

11. 그 밖에 정부에서 수시 지정하는 날

제3조(대체공휴일)

① 제2조제2호부터 제10호까지의 공휴일이 다음 각 호의 어느 하나에 해당하는 경우에는 그 공휴일 다음의 첫 번째 비공휴일(제2조 각 호의 공휴일이 아닌 날을 말한다. 이하 같다)을 대체공휴일로 한다. <개정 2023.5.4, 2026.4.30>

1. 제2조제2호, 제5호부터 제7호까지 또는 제10호의 공휴일이 토요일이나 일요일과 겹치는 경우

2. 제2조제4호 또는 제9호의 공휴일이 일요일과 겹치는 경우

3. 제2조제2호, 제4호부터 제7호까지, 제9호 또는 제10호의 공휴일이 토요일ㆍ일요일이 아닌 날에 같은 조 제2호부터 제10호까지의 규정에 따른 다른 공휴일과 겹치는 경우

② 제1항에 따른 대체공휴일이 같은 날에 겹치는 경우에는 그 대체공휴일 다음의 첫 번째 비공휴일까지 대체공휴일로 한다.

③ 제1항 및 제2항에 따른 대체공휴일이 토요일인 경우에는 그 다음의 첫 번째 비공휴일을 대체공휴일로 한다.

제4조(임시공휴일의 지정) 제2조제11호에 따른 공휴일을 지정하려는 경우에는 국무회의의 심의를 거쳐야 한다.

부칙 <제13155호,1990.11.5> 이 영은 1991년 1월 1일부터 시행한다.

부칙 <제15939호,1998.12.18> 이 영은 1999년 1월 1일부터 시행한다.

부칙 <제18893호,2005.6.30> ①(시행일) 이 영은 공포한 날부터 시행한다. ②(국경일중 제헌절에 관한 경과조치) 제2조제2호의 개정규정에 불구하고 제헌절에 관하여는 2007년 12월 31일까지 공휴일로 한다.

부칙 <제19674호,2006.9.6> 이 영은 공포한 날부터 시행한다.

부칙 <제24273호,2012.12.28> 이 영은 공포한 날부터 시행한다.

부칙 <제24828호,2013.11.5> 이 영은 공포한 날부터 시행한다.

부칙 <제28394호,2017.10.17> 이 영은 공포한 날부터 시행한다.

부칙 <제31930호,2021.8.4> 이 영은 공포한 날부터 시행한다. 다만, 제1조의 개정규정은 2022년 1월 1일부터 시행한다.

부칙 <제33448호,2023.5.4> 이 영은 공포한 날부터 시행한다.

부칙 <제36290호,2026.4.30> 이 영은 2026년 5월 1일부터 시행한다. 다만, 제2조 각 호 외의 부분 단서 및 같은 조 제2호의 개정규정은 2026년 5월 11일부터 시행한다.
