제1조 (목적) 이 영은 국가공무원법 제3조제3항의 규정에 의한 공무원의 범위를 정함을 목적으로 한다. <개정 1981.6.5, 2002.7.10>

제2조 (범위) 국가공무원법 제3조제3항의 규정에 의한 공무원의 범위를 다음과 같이 정한다. <개정 1972.2.16, 1981.6.5, 1991.12.26, 1994.11.26, 2002.7.10>

1. 대통령.

2. 국무총리.

3. 국무위원.

4. 국회의원.

5. 처의 장.

6. 각 원ㆍ부ㆍ처의 차관.

7. 삭제 <1991.12.26>

8. 정무차관

9. 제1호 내지 제3호ㆍ제5호 및 제6호에 규정된 공무원의 비서실장 및 비서관과 전직대통령의 비서관.

10. 국회의장ㆍ국회부의장 및 국회의원의 비서실장ㆍ보좌관ㆍ비서관 및 비서와 교섭단체의 정책연구위원

부칙 <제5037호,1970.6.15> 이 영은 공포한 날로부터 시행한다.
