제1조(목적) 이 영은 「부정수표 단속법」을 시행하는 데 필요한 사항을 규정함을 목적으로 한다.

제2조(금융기관의 범위 등)

① 「부정수표 단속법」(이하 "법"이라 한다)에 따른 금융기관은 「수표법」과 그 밖의 법령에 따라 수표의 지급 사무를 처리하는 은행 및 은행과 같이 취급되는 사람 또는 시설로 한다.

② 법 제2조제1항제1호에 따른 가공인물의 명의는 수표발행인의 명의가 개인인 경우에는 주민등록표상의 성명과 일치하지 아니하는 것으로 하고, 법인인 경우에는 법인 등기사항증명서상의 상호ㆍ명칭과 일치하지 아니하는 것으로 한다.

③ 법 제2조제2항에 따른 제시기일은 「수표법」 제28조제2항에 따라 수표를 제시한 날 및 같은 법 제29조에 따라 지급제시기간에 금융기관에 지급을 받기 위하여 수표를 제시한 날로 한다.

④ 법 제2조제2항에 따른 제시기일에 지급되지 아니하게 한 경우는 「수표법」 제39조의 지급거절을 증명하였을 때로 한다.

부칙 <제4627호,1970.2.16> 이 영은 공포한 날로부터 시행한다.

부칙 <제23365호,2011.12.13> 이 영은 공포한 날부터 시행한다.
