육군특수전사령부령

제1조(설치와 임무) 육군의 특수전을 수행하기 위하여 육군에 육군특수전사령부(이하 "사령부"라 한다)를 둔다.

제2조(사령관등의 임명)

①사령부에 사령관 및 참모장을 둔다.

②사령관 및 참모장은 육군의 장성급(將星級)장교로 보한다. <개정 2017.9.5>

③전시에는 사령부에 부사령관을 두되, 육군의 장성급장교로 보한다. <개정 2017.9.5>

제3조(사령관등의 직무)

①사령관은 국군조직법 제9조제3항의 규정에 의하여 합동참모의장의 작전지휘ㆍ감독을 받을 경우를 제외하고는 육군참모총장의 명을 받아 사령부의 업무를 통할하며, 사령부에 예속 또는 배속된 특수전부대를 지휘ㆍ감독한다.

②부사령관은 사령관을 보좌하며, 사령관이 사고가 있을 때에는 그 직무를 대행한다.

③참모장은 사령관을 보좌하여, 참모업무를 조정ㆍ통제 및 감독한다.

제4조(부서와 부대의 설치)

①사령부에 필요한 참모부서와 부대를 둔다.

②제1항의 참모부서의 설치와 업무분장에 관한 사항은 육군참모총장이, 부대의 설치ㆍ임무와 조직에 관한사항은 국방부장관이 정한다.

제5조(정원) 사령부에 두는 군인 및 군무원의 정원은 국방부장관이 정한다.

부칙 <제13124호,1990.9.29> 이 영은 1990년 10월 1일부터 시행한다.

부칙(군인사법 시행령) <제28266호,2017.9.5> 제1조(시행일) 이 영은 공포한 날부터 시행한다. <단서 생략> 제2조 및 제3조 생략 제4조(다른 법령의 개정) ①부터 <68>까지 생략 <69> 육군특수전사령부령 일부를 다음과 같이 개정한다. 제2조제2항 중 "장관급"을 "장성급(將星級)"으로 하고, 같은 조 제3항 중 "장관급"을 "장성급"으로 한다. <70>부터 <90>까지 생략
