제1조(목적) 이 규칙은 「국방ㆍ군사시설 사업에 관한 법률」 및 같은 법 시행령에서 위임된 사항과 그 시행에 필요한 사항을 규정함을 목적으로 한다.

제2조(국방ㆍ군사시설사업계획의 승인 등 신청)

① 「국방ㆍ군사시설 사업에 관한 법률 시행령」(이하 "영"이라 한다) 제3조제1항에 따른 국방ㆍ군사시설사업계획 승인신청서는 별지 제1호서식과 같다.

② 영 제3조제2항에 따른 국방ㆍ군사시설사업계획 변경승인 또는 폐지승인 신청서는 별지 제2호서식과 같다.

③ 제1항 및 제2항에 따른 국방ㆍ군사시설사업계획 승인 또는 변경승인 신청을 받은 담당 공무원은 「전자정부법」 제36조제1항에 따른 행정정보의 공동이용을 통하여 사업예정지역의 토지ㆍ임야 대장 및 토지이용계획 확인서를 확인하여야 한다.

제3조(국방ㆍ군사시설사업 실시계획의 승인 등 신청)

① 영 제4조제1항에 따른 국방ㆍ군사시설사업 실시계획 승인신청서는 별지 제3호서식과 같다.

② 영 제4조제2항에 따른 국방ㆍ군사시설사업 실시계획 변경승인 또는 폐지승인 신청서는 별지 제4호서식과 같다.

제4조(건축등의 승인 신청) 영 제5조제1항에 따라 국방ㆍ군사시설 건축ㆍ축조ㆍ대수선ㆍ용도변경(이하 "건축등"이라 한다)의 승인을 받으려는 사업시행자는 별지 제5호서식의 국방ㆍ군사시설 건축등 승인신청서에 다음 각 호의 구분에 따른 서류를 첨부하여 국방부장관에게 제출하여야 한다. 이 경우 국방ㆍ군사시설 건축의 승인 신청을 받은 담당 공무원은 「전자정부법」 제36조제1항에 따른 행정정보의 공동이용을 통하여 건축할 대지의 지적도(地籍圖)를 확인하여야 한다.

1. 국방ㆍ군사시설 건축의 경우

가. 건축할 대지의 소유 또는 사용에 관한 권리를 증명하는 서류 1부

나. 건축계획서 1부

다. 배치도 1부

2. 국방ㆍ군사시설 축조의 경우

가. 배치도 1부

나. 구조도 1부

3. 국방ㆍ군사시설 대수선의 경우

가. 대수선하려는 층의 평면도 1부

나. 대수선하려는 층의 단면도 1부

4. 국방ㆍ군사시설 용도변경의 경우

가. 용도를 변경하려는 층의 변경 전 및 변경 후의 평면도 각 1부

나. 용도변경에 따라 변경되는 내화ㆍ내장ㆍ방화 또는 피난 건축설비에 관한 도서(圖書) 각 1부

제5조(준공검사 등) 사업시행자는 국방ㆍ군사시설의 건축등을 마쳤을 때에는 별지 제6호서식의 준공검사 신청서에 공사감리보고서 및 현황 도면 각 1부를 첨부하여 국방부장관에게 제출하여야 한다.

부칙 <제756호,2012.1.26> 이 규칙은 2012년 1월 26일부터 시행한다.
