제1조(목적) 이 규칙은 「도로교통법」 제165조제2항, 경범죄 처벌법 제9조제2항의 규정에 의한 즉결심판청구의 취소절차에 필요한 사항을 규정함을 목적으로 한다. <개정 2009.1.9, 2014.4.3>

제2조(즉결심판청구 취소의 방식)

①「도로교통법」 제165조제2항, 경범죄 처벌법 제9조제2항의 규정에 의한 즉결심판청구의 취소는 별지 제1호서식의 즉결심판청구 취소장으로 하여야 한다. 다만, 법정에서는 구술로써 할 수 있다. <개정 2009.1.9, 2014.4.3>

②제1항 단서의 경우에는 법원서기관, 법원사무관, 법원주사 또는 법원주사보는 이를 기록하여야 한다.

제3조(즉결심판청구 취소의 효력) 제2조제1항의 규정에 의한 즉결심판청구의 취소가 있으면 그 사건에 관한 즉결심판절차는 취소시에 종료된다.

부칙 <제1758호,2002.6.1> 이 규칙은 2002. 7. 1.부터 시행한다.

부칙 <제2209호,2009.1.9> 이 규칙은 공포한 날부터 시행한다.

부칙 <제2529호,2014.4.3> 이 규칙은 공포한 날부터 시행한다.
