제1조 (목적) 이 규칙은 「제주특별자치도 설치 및 국제자유도시 조성을 위한 특별법」 제363조제5항에 따른 범칙금의 양정기준을 정함을 목적으로 한다.

제2조 (범칙금의 양정기준) 「제주특별자치도 설치 및 국제자유도시 조성을 위한 특별법(이하 "법"이라 한다)」 제355조의 죄에 해당하는 자에 대한 범칙금의 양정기준은 별표와 같다.

제3조 (범칙금의 감경)

① 제2조에 따른 범칙금은 출입국관리사무소장ㆍ출입국관리사무소출장소장 또는 외국인보호소장이 해당 위반자의 연령과 환경, 법 위반의 동기와 결과, 범칙금 부담능력 및 위반횟수 등을 고려하여 제2조에 따른 범칙금 양정기준액의 2분의 1의 범위에서 이를 감경할 수 있다.

② 제1항에 불구하고 출입국관리사무소장ㆍ출입국관리사무소출장소장 또는 외국인보호소장이 범칙금 양정기준액의 2분의 1의 범위를 초과하여 범칙금을 감경하려는 때에는 그 이유를 소명하는 자료를 첨부하여 미리 법무부장관의 승인을 얻어야 한다.

부칙 <제611호,2007.5.25> 제1조 (시행일) 이 규칙은 공포한 날부터 시행한다. 제2조 (다른 법령의 폐지) 「제주국제자유도시특별법제112조제5항의규정에의한범칙금양정기준에관한규칙」은 폐지한다.
