독립유공자예우에 관한 법률에 의한 가족관계등록 사무처리규칙

제1조(목적) 이 규칙은 「독립유공자예우에 관한 법률」 제4조의2에 따른 가족관계등록의 창설절차에 관하여 필요한 사항을 규정함을 목적으로 한다.

제2조(신청권자) 독립유공자의 가족관계등록창설 허가신청은 국가보훈처장이 할 수 있다.

제3조(신청절차)

① 국가보훈처장은 서울가정법원에 가족관계등록창설 허가신청서를 제출한다.

② 국가보훈처장은 독립유공자의 등록기준지를 정할 때 유족이 있는 경우에는 그 의사를 반영하여야 한다.

③ 가족관계등록창설 허가신청서에는 국가보훈처가 독립유공자임을 확인한 서면 및 국가보훈처가 작성한 공적조서를 첨부하여야 한다.

④ 가족관계등록창설 허가신청서에는 가족관계등록창설을 하려는 곳의 시(구)ㆍ읍ㆍ면의 장이 발급하는 무적증명서, 가족관계등록부의 기록방법에 준하여 작성한 신분표, 본인의 출생ㆍ사망사실을 소명하는 자료, 부모를 기록하는 경우 그 소명 자료 등을 첨부하여야 한다.

제4조(서울가정법원의 업무)

① 서울가정법원은 국가보훈처장의 가족관계등록창설 허가신청서를 받은 때에는 지체 없이 허가 여부를 결정하여야 한다.

② 가족관계등록창설 허가를 한 때에는 해당 등록기준지의 시(구)ㆍ읍ㆍ면의 장에게 가족관계등록 창설 허가등본을 송부하여야 한다.

제5조(시（구）ㆍ읍ㆍ면의의 장의 처리)

① 시(구)ㆍ읍ㆍ면의 장은 가족관계등록창설 허가등본을 송부받은 때에는 해당 가족관계등록부를 지체없이 작성하되, 작성과 동시에 사망기록 후 폐쇄처리하여야 한다.

② 시(구)ㆍ읍ㆍ면의 장은 해당 가족관계등록부를 작성한 후, 그 가족관계증명서 및 기본증명서 각 1통을 발급하여 국가보훈처장에게 송부하여야 한다.

제6조(일반사항) 이 규칙에서 정하지 아니한 사항은 「가족관계의 등록 등에 관한 법률」, 「가족관계의 등록 등에 관한 규칙」에서 정하는 절차에 따른다.

부칙 <제2220호,2009.2.17> 이 규칙은 공포한 날부터 시행한다.
