축사의 부동산등기에 관한 특례법

제1조(목적) 이 법은 개방형 축사의 부동산등기에 관한 특례를 규정하여 개방형 축사에 대한 재산권 보장과 거래의 안전을 목적으로 한다.

제2조(정의) 이 법에서 "개방형 축사"란 소(牛)의 질병을 예방하고 통기성(通氣性)을 확보할 수 있도록 둘레에 벽을 갖추지 아니하고 소를 사육하는 용도로 사용할 수 있는 건축물을 말한다.

제3조(등기 요건) 다음 각 호의 요건을 모두 갖춘 개방형 축사는 건물로 본다. <개정 2019.8.20>

1. 토지에 견고하게 정착되어 있을 것

2. 소를 사육할 용도로 계속 사용할 수 있을 것

3. 지붕과 견고한 구조를 갖출 것

4. 건축물대장에 축사로 등록되어 있을 것

5. 연면적이 100제곱미터를 초과할 것

제4조(부동산등기) 제3조 각 호의 요건을 모두 갖춘 개방형 축사는 「부동산등기법」에서 정하는 절차에 따라 건물등기부에 등기할 수 있다.

제5조(대법원규칙) 이 법의 시행에 필요한 사항은 대법원규칙으로 정한다.

부칙 <제9805호,2009.10.21> 이 법은 공포 후 3개월이 경과한 날부터 시행한다.

부칙 <제16446호,2019.8.20> 이 법은 공포 후 3개월이 경과한 날부터 시행한다.
