제1조(목적) 이 규칙은 「축사의 부동산등기에 관한 특례법」(이하 "법"이라 한다)의 위임에 따라 그 시행에 필요한 사항을 규정함을 목적으로 한다.

제2조(축사의 보존등기)

① 법 제4조에 따라 개방형 축사의 소유권보존등기를 신청하는 경우에는 신청서에 법에 따라 등기를 신청한다는 뜻을 적어야 한다.

② 제1항에 따라 등기를 할 경우 등기관은 등기기록 중 표제부에 법에 따른 등기임을 기록한다.

제3조(제출서면)

① 제2조제1항의 등기를 신청하는 경우에는 신청서에 건물의 표시를 증명하는 건축물대장등본을 첨부하여야 한다.

② 법 제3조제2호의 "소를 사육할 용도로 계속 사용할 수 있을 것"을 소명하기 위하여 다음 각호의 어느 하나를 제출하여야 한다. 다만, 건축물대장등본에 의하여 등기할 건축물의 용도가 개방형 축사임을 알 수 있는 경우에는 그러하지 아니하다.

1. 건축허가신청서나 건축신고서의 사본(건축사가 작성한 축사 설계도 또는 「건축법」 제23조제4항 및 「표준설계도서등의운영에관한규칙」 제3조에 따른 축사 표준설계도서가 첨부된 것에 한한다)

2. 그 밖에 건축물의 용도가 개방형 축사임을 알 수 있는 시ㆍ구ㆍ읍ㆍ면의 장이 작성한 서면

제4조(준용규정) 이 규칙에 특별한 규정이 없는 경우에는 성질에 반하지 아니하는 한 「부동산등기규칙」을 준용한다.

부칙 <제2266호,2009.12.31> 이 규칙은 2010년 1월 22일부터 시행한다.
