방위산업기술 보호법 시행규칙

제1조(목적) 이 규칙은 「방위산업기술 보호법」 및 같은 법 시행령에서 위임된 사항과 그 시행에 필요한 사항을 규정함을 목적으로 한다.

제2조(이해관계인의 의견 진술) 「방위산업기술 보호법 시행령」(이하 "영"이라 한다) 제12조제2항에 따른 이해관계인 의견 진술서는 별지 제1호서식과 같다.

제3조(방위산업기술 판정 신청 등)

① 영 제13조제1항에 따른 방위산업기술 판정 신청서는 별지 제2호서식과 같다.

② 영 제13조제4항에 따른 방위산업기술 판정서는 별지 제3호서식과 같다.

제4조(방위산업기술 유출 및 침해 신고) 영 제16조제1항에 따른 방위산업기술 유출 및 침해 신고서 또는 조사 및 조치 요청서는 별지 제4호서식과 같다. <개정 2021.6.22>

제4조의2(조사)

① 「방위산업기술 보호법」(이하 "법"이라 한다) 제11조의2제2항에 따른 출석요구서, 같은 조 제3항에 따른 보고요구서 및 같은 조 제4항에 따른 자료제출요구서는 각각 별지 제5호서식과 같다.

② 법 제11조의2제5항에 따른 현장출입조사서는 별지 제6호서식과 같다.

③ 영 제16조의2제1항에 따른 발송확인대장은 별지 제7호서식과 같다.

④ 영 제16조의2제3항에 따른 조사 연기 신청서는 별지 제8호서식과 같다.

⑤ 영 제16조의2제4항에 따른 조사 연기 신청 결과 통지서는 별지 제9호서식과 같다.

⑥ 영 제16조의2제5항에 따른 의견제출서는 별지 제10호서식과 같다.

⑦ 영 제16조의2제6항에 따른 조사 결과 통지서는 별지 제11호서식과 같다.

제4조의3(방위산업기술 보호지원 전담기관의 지정신청 등)

① 영 제21조의2제2항에서 "국방부령으로 정하는 전담기관 지정신청서"란 별지 제12호서식의 방위산업기술 보호지원 전담기관 지정신청서를 말한다.

② 영 제21조의2제2항에 따라 전담기관 지정신청서를 제출받은 방위사업청장은 「전자정부법」 제36조제1항에 따른 행정정보의 공동이용을 통해 법인 등기사항증명서를 확인해야 한다.

③ 영 제21조의2제3항에서 "국방부령으로 정하는 전담기관 지정서"란 별지 제13호서식의 방위산업기술 보호지원 전담기관 지정서를 말한다.

제5조(포상금의 지급기준)

① 영 제22조제2항에 따른 포상금의 지급기준은 별표와 같다.

② 포상 및 포상금의 세부적인 지급 방법 등에 관하여 필요한 사항은 방위사업청장이 정한다.

부칙 <제898호,2016.6.28> 이 규칙은 2016년 6월 30일부터 시행한다.

부칙 <제1055호,2021.6.22> 이 규칙은 2021년 6월 23일부터 시행한다.

부칙 <제1177호,2025.6.2> 이 규칙은 2025년 6월 4일부터 시행한다.
