부정청탁 및 금품등 수수의 금지에 관한 법률의 시행에 관한 대법원 규칙

제1조(목적) 이 규칙은「부정청탁 및 금품 등 수수의 금지에 관한 법률」(이하 "법"이라 한다)에서 대법원규칙에 위임된 사항과 법 시행에 필요한 사항을 규정함을 목적으로 한다.

제2조(소속기관장의 부정청탁을 받은 공직자등에 대한 조치)

① 법 제7조제4항제4호에서 "대법원규칙으로 정하는 조치"란 다음 각 호의 어느 하나에 해당하는 조치를 말한다.

1. 직무 공동수행자의 지정

2. 사무분담의 변경

3. 소송이 계속중인 사건과 관련한 부정청탁이 있는 경우 해당 사건의 재배당

② 소속기관장은 제1항 제3호의 조치를 취하려면 미리 해당 재판부의 의견을 들어야 한다.

제3조(교육 등)

① 소속기관장은 법 제19조제1항에 따라 매년 부정청탁 금지 및 금품등 수수의 금지에 관한 교육계획을 수립하여야 한다.

② 제1항에 따른 교육계획에는 교육의 대상ㆍ내용ㆍ방법 등이 포함되어야 한다.

③ 소속기관장은 법 제19조제1항에 따라 공직자등에게 연 1회 이상 교육을 실시하여야 하고, 부정청탁 금지 및 금품등 수수의 금지에 관한 법령을 준수할 것을 약속하는 서약서를 신규임용을 할 때 받아야 한다. <개정 2018.3.7>

제4조(고유식별정보 등의 처리) 소속기관장은 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법」 제23조에 따른 민감정보, 같은 법 시행령 제19조제1호, 제2호 및 제4호에 따른 주민등록번호, 여권번호 및 외국인등록번호가 포함된 자료를 처리할 수 있다.

1. 법 제7조 및 제9조에 따른 부정청탁 및 수수 금지 금품등의 신고ㆍ처리 등에 관한 사무

2. 법 제10조에 따른 외부강의등의 신고ㆍ처리 등에 관한 사무

3. 법 제13조 및 제14조에 따른 법 위반행위의 신고ㆍ처리 등에 관한 사무

4. 법 제15조에 따른 신고자등의 보호ㆍ보상에 관한 사무

5. 법 제17조에 따른 부당이득의 환수에 관한 사무

부칙 <제2699호,2016.11.29> 이 규칙은 공포한 날부터 시행한다.
