제1조(목적) 이 영은 지방자치단체가 해당 지역에서 발생한 역사적 사건을 기념할 수 있는 날을 지방공휴일로 지정할 수 있도록 함으로써, 해당 기념일의 역사적 의의를 높이고 주민의 통합과 화합을 도모함을 목적으로 한다.

제2조(정의) 이 영에서 "지방공휴일"이란 지방자치단체의 관공서가 특별히 휴무(休務)하는 날을 말한다.

제3조(지정 요건)

① 지방자치단체는 조례로 다음 각 호의 요건을 모두 갖춘 날을 지방공휴일로 지정할 수 있다.

1. 「각종 기념일 등에 관한 규정」에 따른 기념일일 것

2. 해당 지방자치단체에서 발생한 역사적 사건을 특별히 기념하기 위한 날일 것

3. 해당 지방자치단체의 주민의 통합과 화합을 도모할 수 있는 날일 것

② 지방자치단체가 제1항에 따라 지방공휴일을 지정하려는 경우, 해당 지방자치단체의 장은 미리 「각종 기념일 등에 관한 규정」 제2조제1항에 따라 해당 기념일을 주관하는 부처의 장과 협의하여야 한다.

제4조(휴무 등의 권고) 지방자치단체는 지방공휴일에 해당 지방자치단체의 주민이 역사적 사건을 함께 기념할 수 있도록 해당 지역 안의 학교 및 기업 등에 휴업ㆍ휴무 등을 권고할 수 있다.
