법률지원단의 구성 및 운영에 관한 규칙

제1조(목적) 이 규칙은 「교원의 지위 향상 및 교육활동 보호를 위한 특별법」 제14조의2에서 위임된 사항과 그 시행에 필요한 사항을 규정함을 목적으로 한다.

제2조(법률지원단의 구성)

① 「교원의 지위 향상 및 교육활동 보호를 위한 특별법」(이하 "법"이라 한다) 제14조의2제1항에 따라 교육부장관 소속으로 두는 법률지원단(이하 "법률지원단"이라 한다)은 단장 1명을 포함하여 5명 이상 7명 이내의 단원으로 구성한다.

② 법률지원단의 단장(이하 "단장"이라 한다)은 교육부 학교혁신정책관이 된다.

③ 법률지원단의 단원은 다음 각 호의 사람이 된다.

1. 교육부 교원정책과장

2. 변호사 등 법률전문가 중에서 성별을 고려하여 교육부장관이 위촉하는 사람

④ 법률지원단의 업무를 지원하기 위하여 법률지원단에 간사 1명을 두며, 간사는 교육부 소속 공무원 중에서 교육부장관이 지명한다.

제3조(단원의 임기) 제2조제3항제2호에 따라 위촉되는 단원(이하 "위촉단원"이라 한다)의 임기는 2년으로 하며, 한 차례만 연임할 수 있다.

제4조(단원의 해촉) 교육부장관은 위촉단원이 다음 각 호의 어느 하나에 해당하는 경우에는 해당 단원을 해촉할 수 있다.

1. 심신장애로 인하여 직무를 수행할 수 없게 된 경우

2. 직무와 관련된 비위사실이 있는 경우

3. 직무태만, 품위손상이나 그 밖의 사유로 단원으로 적합하지 않다고 인정되는 경우

4. 단원 스스로 직무를 수행하기 어렵다는 의사를 밝히는 경우

제5조(단장의 직무)

① 단장은 법률지원단을 대표하고, 법률지원단의 업무를 총괄한다.

② 단장이 부득이한 사유로 직무를 수행할 수 없을 때에는 단장이 미리 지명한 단원이 그 직무를 대행한다.

제6조(운영세칙) 이 규칙에서 규정한 사항 외에 법률지원단의 운영에 필요한 사항은 교육부장관이 정한다.

부칙 <제191호,2019.10.17> 이 규칙은 2019년 10월 17일부터 시행한다.
