제1조(목적) 이 법은 대한민국 정부 및 독일연방공화국 정부 간 경제 및 기술협조 등의 일환으로 독일에 진출하여 근로한 광부ㆍ간호사ㆍ간호조무사의 노고와 희생을 기념하고 국가경제 발전에 기여한 이들의 공로에 걸맞은 기념사업 및 지원에 필요한 사항을 규정함을 목적으로 한다.

제2조(지원대상) 이 법에서 적용받는 지원대상은 다음과 같다

1. 1961년에 체결된 「대한민국 정부와 독일연방공화국간의 경제 및 기술원조에 관한 의정서」, 1963년 12월 체결된 「한국 광부의 임시 고용계획에 관한 협정」에 따라 1963년 12월 21일부터 1977년 12월 31일까지 독일에 진출하여 임금을 목적으로 근로를 제공한 광부

2. 1966년 1월 29일부터 한국해외개발공사를 통한 알선과 1969년 8월 체결된 「한국해외개발공사와 독일 병원협회 간 협정」에 따라 1976년 12월 31일까지 독일에 진출하여 임금을 목적으로 근로를 제공한 간호사 및 간호조무사

제3조(지원대상자에 대한 지원)

① 국가는 지원대상자에게 다음 각 호의 지원을 할 수 있다.

1. 대한민국 또는 거주 중인 국가에서의 생활에 필요한 사회서비스 안내 등 기본정보의 제공

2. 대한민국 정착에 필요한 교육 또는 상담

3. 파독 광부ㆍ간호사ㆍ간호조무사 관련 기관 및 단체와의 연계

② 그 밖에 제1항 각 호에 따른 지원의 범위, 방법 등에 관하여 필요한 사항은 대통령령으로 정한다.

제4조(기념사업 등)

① 국가는 파독 광부ㆍ간호사ㆍ간호조무사와 관련된 다음 각 호의 사업을 할 수 있다.

1. 기념관 건립 등 기념사업

2. 역사적 자료의 수집ㆍ보존ㆍ관리ㆍ전시 및 조사ㆍ연구

3. 교육ㆍ홍보 및 학술활동

4. 국제교류, 공동조사 등 국내외 활동

5. 그 밖에 제1호부터 제4호까지의 사업에 부수되는 사업

② 제1항에 따른 사업을 수행하기 위하여 필요한 사항은 대통령령으로 정한다.

제5조(경비의 보조) 국가는 대통령령으로 정하는 요건을 갖춘 법인 또는 단체가 제4조제1항 각 호의 사업을 수행하는 경우 예산의 범위에서 사업에 필요한 비용의 전부 또는 일부를 보조할 수 있다.

제6조(업무의 위탁) 이 법에 따른 고용노동부장관의 업무는 그 일부를 대통령령으로 정하는 바에 따라 관련 법인 또는 단체에 위탁할 수 있다.

부칙 <제17436호,2020.6.9> 이 법은 공포 후 1년이 경과한 날부터 시행한다.
