변호사ㆍ법무사의 자격이 있는 보증인의 보수에 관한 규칙

제1조(목적) 이 규칙은 「부동산소유권 이전등기 등에 관한 특별조치법」 제11조제4항에 따른 보증인의 보수에 관한 사항을 규정함을 목적으로 한다.

제2조(보수의 기준) 「부동산소유권 이전등기 등에 관한 특별조치법」 (이하 "법"이라 한다) 제11조제2항제2호에 따른 변호사ㆍ법무사의 자격이 있는 보증인(이하 "자격보증인"이라 한다)의 보수는 450만원을 초과하지 않는 범위에서 법 제11조제1항에 따른 확인서를 발급받으려는 자와 자격보증인 간의 약정으로 정한다. 다만, 다음 각 호의 사항을 고려하여 450만원의 25퍼센트 범위에서 그 금액을 늘릴 수 있다.

제3조(보증 업무를 수행할 수 없게 된 경우의 보수) 자격보증인은 보증 업무를 시작한 이후 다음 각 호의 어느 하나에 해당하는 사유로 보증 업무를 수행할 수 없게 되었을 때에는 제2조 각 호 외의 부분 본문에 따라 약정한 보수의 60퍼센트 범위에서 보수를 받을 수 있다.

부칙 <제974호,2020.7.31> 이 규칙은 2020년 8월 5일부터 시행한다.
