어린이안전관리에 관한 법률 시행규칙

제1조(목적) 이 규칙은 「어린이안전관리에 관한 법률」 및 같은 법 시행령에서 위임된 사항과 그 시행에 필요한 사항을 규정함을 목적으로 한다.

제2조(어린이안전교육 전문기관의 지정 등)

① 「어린이안전관리에 관한 법률 시행령」(이하 "영"이라 한다) 제8조제2항에 따라 어린이안전교육 전문기관(이하 "교육기관"이라 한다)으로 지정받으려는 자는 별지 제1호서식의 교육기관 지정신청서에 다음 각 호의 서류를 첨부하여 행정안전부장관에게 제출해야 한다.

1. 정관 또는 이에 준하는 사업운영규정

2. 사업계획서

3. 어린이안전교육(이하 "안전교육"이라 한다)이 가능한 전문인력을 확보하였음을 증명할 수 있는 서류

4. 안전교육에 필요한 시설 및 장비를 확보하였음을 증명할 수 있는 서류

② 영 제8조제2항에 따른 신청을 받은 행정안전부장관은 「전자정부법」 제36조제1항에 따른 행정정보의 공동이용을 통하여 법인 등기사항증명서(법인인 경우만 해당한다)를 확인해야 한다.

③ 영 제8조제3항에 따른 교육기관 지정서는 별지 제2호서식에 따른다.

제3조(안전교육 결과의 제출)

① 어린이이용시설 관리주체는 영 제9조제5항에 따라 별지 제3호서식의 전년도 안전교육 실시 결과를 매년 1월 15일까지 관계 중앙행정기관의 장 또는 지방자치단체의 장에게 제출해야 한다.

② 어린이이용시설 관리주체는 별지 제4호서식의 안전교육 실시 현황을 작성하여 관리할 수 있다.

제4조(어린이안전 관리담당자의 지정) 어린이이용시설 관리주체는 「어린이안전관리에 관한 법률」 제17조에 따라 어린이안전 관리담당자를 지정하는 경우에는 별지 제5호서식의 어린이안전 관리담당자 지정 대장을 작성하여 관리할 수 있다.

부칙 <제210호,2020.11.27> 이 규칙은 2020년 11월 27일부터 시행한다.
