대법원 윤리감사관과 그 보좌기관 및 분장사무에 관한 규칙

제1조(목적) 이 규칙은 법원조직법 제71조의2제1항에 따라 대법원 윤리감사관의 지위, 윤리감사관의 보좌기관과 분장사무에 관한 사항을 규정함을 목적으로 한다.

제2조(윤리감사관)

① 윤리감사관은 대법원장의 지휘를 받아 법원 감사업무(다만, 「법원재판사무 처리규칙」 제5조에 의한 ‘재판사무 등에 관한 감사’를 제외한다), 법관 및 법원공무원의 공직윤리에 관한 업무를 관장한다.

② 윤리감사관은 정무직으로 하되, 그 보수는 차관의 보수와 같은 금액으로 한다.

제3조(보좌기관 및 분장사무)

① 윤리감사관을 보좌하기 위하여 심의관 또는 담당관을 둘 수 있으며, 그 명칭과 분장사무는 별표와 같이 한다.

② 윤리감사관이 궐위되거나 부득이한 사유로 직무를 수행할 수 없을 때에는 윤리감사총괄심의관이 그 권한을 대행한다.

③ 윤리감사총괄심의관은 판사로 보하고, 윤리감사심의관은 판사, 법원이사관 또는 법원부이사관으로 보한다.

제4조(비밀준수 의무) 윤리감사관과 소속 직원 및 그 직에 있었던 사람은 해당 직무를 수행하면서 알게 된 내용을 누설하여서는 아니 된다.

부칙 <제2954호,2021.1.29> 이 규칙은 2021년 2월 9일부터 시행한다.

부칙 <제3162호,2024.8.29> 이 규칙은 공포한 날부터 시행하되, 2024년 3월 1일부터 적용한다.
