제1조(목적) 이 규칙은 「중소기업 스마트제조혁신 촉진에 관한 법률」 및 같은 법 시행령에서 위임된 사항과 그 시행에 필요한 사항을 규정함을 목적으로 한다.

제2조(스마트제조혁신 추진기관 지정 신청 등)

① 「중소기업 스마트제조혁신 촉진에 관한 법률 시행령」(이하 "영"이라 한다) 제5조제2항에서 "중소벤처기업부령으로 정하는 추진기관 지정신청서"란 별지 제1호서식을 말한다.

② 영 제5조제3항에서 "중소벤처기업부령으로 정하는 스마트제조혁신 추진기관 지정서"란 별지 제2호서식을 말한다.

③ 제2항에 따른 스마트제조혁신 추진기관 지정서를 분실했거나 훼손으로 못쓰게 되어 재발급받으려는 자는 별지 제3호서식의 스마트제조혁신 추진기관 지정서 재발급신청서에 다음 각 호의 구분에 따른 서류를 첨부하여 중소벤처기업부장관에게 제출해야 한다.

1. 스마트제조혁신 추진기관 지정서를 분실한 경우에는 그 사유서

2. 스마트제조혁신 추진기관 지정서가 훼손으로 못쓰게 된 경우에는 그 원본

제3조(스마트공장 수준 확인 신청 등)

① 영 제10조제2항에서 "중소벤처기업부령으로 정하는 스마트공장 수준확인 신청서"란 별지 제4호서식을 말한다.

② 영 제10조제2항에서 "스마트공장 수준 자가진단표 등 중소벤처기업부령으로 정하는 서류"란 다음 각 호의 서류를 말한다.

1. 스마트공장 수준 자가진단표

2. 사업자등록증명원

3. 국세ㆍ지방세 납세증명서

③ 영 제10조제4항에서 "중소벤처기업부령으로 정하는 스마트공장 수준확인서"란 별지 제5호서식을 말한다.

제4조(제조데이터 전문기관 지정 신청 등)

① 영 제12조제2항에서 "중소벤처기업부령으로 정하는 전문기관 지정신청서"란 별지 제6호서식을 말한다.

② 영 제12조제3항에서 "중소벤처기업부령으로 정하는 제조데이터 전문기관 지정서"란 별지 제7호서식을 말한다.

③ 제2항에 따른 제조데이터 전문기관 지정서의 재발급에 관하여는 제2조제3항을 준용한다. 이 경우 "스마트제조혁신 추진기관"은 "제조데이터 전문기관"으로 본다.

제5조(규제개선 요청서) 영 제22조제1항에서 "중소벤처기업부령으로 정하는 규제개선 요청서"란 별지 제8호서식을 말한다.

부칙 <제72호,2023.7.3> 이 규칙은 2023년 7월 4일부터 시행한다.
