보훈기금법 시행규칙

제1조(목적) 이 규칙은 「보훈기금법」 및 같은 법 시행령에서 위임된 사항과 그 시행에 필요한 사항을 규정함을 목적으로 한다.

제2조(기부금품 모집기관의 지정)

① 「보훈기금법 시행령」(이하 "영"이라 한다) 제2조제2항 각 호 외의 부분에 따른 모집기관 지정신청서는 별지 제1호서식과 같다.

② 국가보훈부장관은 영 제2조제2항에 따른 지정 신청을 받은 경우에는 「전자정부법」 제36조제1항에 따른 행정정보의 공동이용을 통하여 다음 각 호의 어느 하나에 해당하는 행정정보를 확인해야 한다. 다만, 신청인이 확인에 동의하지 않는 경우에는 그 서류를 첨부하도록 해야 한다.

제3조(기부금품의 접수)

① 영 제3조제3항 본문에 따른 기부금품 기부서는 별지 제2호서식과 같다.

② 국가보훈부장관은 영 제3조제3항에 따른 기부금품 기부서를 받은 경우에는 「전자정부법」 제36조제1항에 따른 행정정보의 공동이용을 통하여 다음 각 호의 구분에 따른 행정정보를 확인할 수 있다. 다만, 기부자가 확인에 동의하지 않는 경우에는 그 서류를 첨부하도록 해야 한다.

1. 기부자가 개인인 경우: 주민등록표 초본 또는 외국인등록사실증명

2. 기부자가 법인 또는 단체인 경우: 법인등기사항증명서 또는 사업자등록증명

③ 영 제3조제6항 후단에 따른 모집비용 지출내역서는 별지 제3호서식과 같다.

제4조(기부금품의 접수결과 보고) 모집기관은 영 제4조제1항 후단에 따라 기부금품의 접수결과를 국가보훈부장관에게 보고하려는 경우에는 별지 제4호서식의 기부금품 접수결과 보고서에 모집공고서 사본을 첨부하여 국가보훈부장관에게 제출해야 한다.

부칙 <제28호,2024.6.24> 이 규칙은 공포한 날부터 시행한다.
